Affordable Virtual Family Law Appointments!

Today’s technology-driven-world, in many cases, has created a world of convenience, specifically for our Family Law Office and divorce attorney, Mr. James J. Kenny. Our family law office is now offering virtual appointments, also known as, telecommuting.

Virtual family law, Rancho cucamonga,Wikipedia defines Telecommuting as; work from home and making use of the internet, cell phones and email instead of face-to-face appointments that would normally require time and travel to an office or meeting location. Although Mr. Kenny will still be traveling to the family law office in Rancho Cucamonga, Ca from Monday through Friday every week, we now offer the ability for our clients to discuss their family law cases through video calling, phone calls or emails. This not only saves our clients money, but also saves them time and gives them the ability to meet with their divorce lawyer from the comfort of their home or wherever they might be.

This means that Mr. Kenny would be able to offer his divorce attorney services to clients anywhere in California that may not be located near Rancho Cucamonga, Ca including but not limited to cities in Orange County, Los Angeles County, San Diego County, Palm Springs or even as far as the San Francisco Bay Area . Some family law services that would require a lawyer to be present in court would not be acceptable for a virtual lawyer but there are a few family law services that can be offered virtually that do not require any face-to-face meetings which include; prenuptial agreements, marriage settlement agreements, some child custody agreements, spousal support agreements, stipulated judgments and/or the dissolution of a marriage.

Domestic Violence Restraining Order Law Change

The Family Law Office of James J. Kenny would like to report that there has been a change in the legal standard for your partner to get a domestic violence restraining order.  In the past, in order to obtain a restraining order, actual physical abuse would have had to happen and it would have needed to be a repeated offense, but according to the Judicial Branch of California now the law has changed to include;  “disturbing someone’s peace”.

The Judicial Branch of California’s website reports;

The domestic violence law says “abuse” is:

Domestic-Violence-Lawyers, Rancho Cucamonga, caMr. Kenny’s take on the legal question to determine if domestic violence has taken place is: has the party engaged in conduct that has disturbed the peace and emotional calm of the other party? This concerns Mr. Kenny because virtually every argument between spouses disturbs the peace and our Law Office worries that this may create an easy opportunity for someone to take advantage of that law to get their way in their divorce or in any family law case for that matter.

A recent seminar that Mr. Kenny went to presented by the LA superior court judge, Trent Lewis concerning domestic violence included an imaginative situation pertaining to domestic violence. When the story was presented as the female being the perpetrator of domestic violence, the male got the restraining order against his spouse 30% of the time. When the names were reversed, the female prevailed 67% of the time proving that people typically side with women over men in regards to domestic violence.

It is recognized that men and woman are both abused parties but it is important to note that men are as abused as woman are and Mr. Kenny sees the misuse of this domestic-violence-restraining-order-law a lot. For people like firefighters, professors, policemen and prison guards, if they are served a restraining order, it could potentially cause them to lose their job affecting their entire lives so it is important to keep in mind this new law stipulation to avoid getting into an unfavorable situation. As women are often-times the victim of domestic violence and the lower wage earner, it is important to assess the type of bad conduct involved and to consider the potential loss of support when seeking a restraining order that may result in a loss of employment.

James J. Kenny is a divorce attorney that specializes in domestic violence and has been practicing family law since 1977. The Family Law Offices of James J. Kenny has offices in Rancho Cucamonga, Ca and San Bernardino, Ca.

Protect Yourself from Kids’ Sexting!

Make sure your children are not sextingIt was recently brought to Mr. Kenny’s attention by a judge, that more and more court cases are coming across the courtroom having to do with children “sexting”.  “Sexting”, according to Wikipedia.com, is the act of sending and receiving sexually explicit messages, primarily between mobile phones.  “Sexting” has become more and more popular with young kids and teens and technology only seems to help the situation.  The Judge went on to say that even if it was the child that was using a cell phone to do the “sexting”, all cell phones are typically opened under the parents’ name because they are the ones paying the bill. If and when a cell phone is confiscated and inappropriate messages are found on the phone, it is not the children that get in trouble for it, the parents, whose name is on the cell phone bill are the ones accused, and the charges can be as harsh as possession of child pornography if there are nude or sexually explicit pictures and messages! This stunned Mr. Kenny and he immediately thought about how this could affect a divorce case, child custody case or any family law case for that matter.  As you can imagine, Mr. James J. Kenny, who is an experienced divorce attorney and family lawyer, handles many family law cases that involve very disgruntled partners that would love nothing more than to find something like this “sexting” issue to blame it on the opposite partner, who legally owns the phone, and create a battle over it. So to avoid this issue, we wanted to warn you about the problem and offer a solution to it!
With a little bit of research, our Family Law Office was able to find out My mobile watchdog logoabout an app that allows parents to spy on their children’s phone activity.  A child Safety website called “My Mobile Watchdog”, has launched a new app that advertises that with their app, you can “monitor your child’s texts, block apps, set what time apps can be used and track location by GPS”. It doesn’t stop there, this Mobile Watchdog app also allows parents the ability to see what their children are doing on their phone including read their text messages, see their picture messages, see their contact history, find a lost phone, block websites and even allows them the ability to see into their Facebook and Instagram apps.
Not every parent will feel the need to be this restricting and strict on their children and we are sure there are other ways to go about protecting yourself, but we also know this is not something to take lightly!

Kenny has office locations in Rancho Cucamonga and San Bernardino, Ca and with the help of associate attorney, Kelly Price, we focus on divorce cases including divorce, child custody, visitation, spousal support, child support, domestic violence, property division, family business and prenuptial agreements. Lower Your Legal Fees and Get More Satisfaction From Your Lawyer!

Lower legal fees through emails and virtual appointmentsJames J. Kenny has been practicing law since 1977 and has been a divorce and family law attorney with the title, “Certified Family Law Specialist” since 1983.  In the past, James J. Kenny conducted most of his business through personal face to face meetings. The client would call to schedule an appointment having to do with their divorce or family law case and depending on how busy he was with other appointments and visits to the courthouses for hearings, that client would be put on the schedule for at least 1-2 weeks out. Then when Mr. Kenny would sit down with the client, his average meeting would take 2-3 hours to complete. Asking questions, answering questions, taking notes, discussing options and always trying to be as thorough as possible. Although Mr. Kenny still conducts his consultations and meetings this way, emailing has become a very common way to communication between these meetings and that is how technology is helping his client’s lower their legal fees and get more satisfaction from him as their Lawyer.

Technology is really improving our way of life in many different ways, especially in James J. Kenny’s Family Law Offices in Rancho Cucamonga and San Bernardino, Ca.  Now that almost all of his clients and prospective clients have emails, correspondence is not only easier, it is a faster way to communicate and it gives each party the ability to take the time to read, digest and respond in the best and most effective way. If a client happens to have a letter they need Mr. Kenny to see or have a copy of, instead of making an appointment to give it to Mr. Kenny and discuss what it is, they can now simply attach the letter in an email with a description, and what would have been an hour long meeting and an hour of lawyer fees, is often cut in half saving money for the client and time for Mr. Kenny.

Another way our Family Law Office clients can lower their legal fees and save on time is through virtual appointments instead of office appointments. With Skype, google video hangouts, Iphone facetime and other video chatting services, technology has offered us the ability to have face to face conversations without actually being in the same room. We can share documents in real time and still communicate in the best way in the comfort of our home, office or anywhere for that matter.
